Den fulla definitionen finns i artikel 4 (11) GDPR.<\/p>\n\n\n\n<p>Samtycke \u00e4r en av sex r\u00e4ttsliga grunder i artikel 6 GDPR som kan r\u00e4ttf\u00e4rdiga behandlingar av personuppgifter. Samtycke \u00e4r inte en l\u00e4mplig r\u00e4ttslig grund n\u00e4r det f\u00f6religger en tydlig obalans mellan den registrerade och personuppgiftsansvarige, till exempel i ett anst\u00e4llningsf\u00f6rh\u00e5llande (arbetsgivare &#8211; anst\u00e4lld) eller vid myndighetsut\u00f6vning (skola &#8211; elev).<\/p>\n\n\n\n<p>Samtycke m\u00e5ste alltid h\u00e4rledas fr\u00e5n ett aktivt val, till exempel att den registrerade klickar i en ruta vid bes\u00f6k av en webbplats. Personuppgiftsansvarig beh\u00f6ver kunna visa att den registrerade gett sitt samtycke till en behandling.
